Summary
I represent clients on a wide range of environmental and natural resources law litigation and counseling matters. I excel at bringing together parties with diverse interests to solve complex problems in a manner that best achieves the objectives of the stakeholders and minimizes the risk of unnecessary litigation and protracted disagreements. I have an active energy and climate change practice. In Colorado, we played a central role in the groundbreaking program to retire all coal-fired power plants in the Front Range. We also helped develop and defend the first statewide rules controlling methane (a potent greenhouse gas) from oil and gas production activities while fostering collaboration between large energy producers and environmental parties. I have counseled governments on developing rules for fracking and other aspects of oil and gas development and have negotiated agreements with oil and gas operators. I am highly experienced in the technical issues related to site evaluation and cleanup and exposure. I have successfully represented numerous clients in Superfund and toxic tort litigation matters, including cases involving mine sites, oil and gas production activities, landfills, bulk chemical storage, weapons manufacturing, and pesticides, among others. I am also a national expert on financial assurance, environmental insurance, fixed-price contractual arrangements and policy/legal restrictions associated with alternative financing approaches to settlement.
